Since 24 February 2014 Channel 5 has broadcast a popular factual/reality documentary series called “Can’t Pay? We’ll Take It Away!”
The programme involves viewers following the work of High Court Enforcement Officers as they work executing High Court Writs across the UK. This involves High Court Enforcement Officers turning up, often unannounced at homes and businesses, trying to extract money from people who have failed to pay debts or leave a property when ordered to do so. In the programme, debtors are “named and shamed”, distressing situations are recorded without consent and then broadcast on national television. Many individuals are caught at their “lowest ebb” and filming often includes not only a debtor but also close family members, in their home.
Many debtors featured on the programme have faced public humiliation and embarrassment as a consequence of being featured on the programme. Whilst the programme focuses on the work of High Court Enforcement Officers to enforce the High Court Writs it is easy to forget that they enter people’s private property and lives at a difficult time and, in filming people in these situations, their privacy may well be invaded.
The people featured in this programme may be entitled to legal redress and compensation for an invasion of their privacy and the misuse of private information. Private individuals who have been targeted by Brinkworth Films, the producers of “Can’t Pay? We’ll Take It Away!” have potential legal actions against Brinkworth Films and Channel 5 for breach of privacy, or misuse of their personal private information, arising out of the broadcasting of their “story” on “Can’t Pay?
